شرعية المثول الفوري وفق القانون الجزائري

الملخص

الملخص: عانت المحاكم الجزائرية من كثرة القضايا المطروحة أمامها، الامر الذي نجم عنه بطء في وتيرة الإجراءات الخاصة بالإحالة والفصل في القضايا، ممّا جعل المشرع الجزائري يسارع في تبني إجراءات جزائية تسرع في تلك الإجراءات حتى يقلل من عدد القضايا المعروضة على القضاء الجزائي، وكذا تبسيط الإجراءات من أجل التسريع في البث فيها، وفي ذات السياق استحدث المشرع الجزائري المثول الفوري الذي جاء وفقا للأمر رقم 15-02 المعدّل والمتمم لقانون الإجراءات الجزائية الجزائري ، حيث تضمن مجموعة من الاحكام الأساسية في سير القضاء الجزائي وأسلوب سير الدعوى العمومية ، الهدف منه تقصير مدة التقاضي واختصار الوقت والجهد وتبسيط الإجراءات، وتفادي فترات الحبس غير المبررة، عندما تكون الحريمة مكتملة الأركان والجاني في حالة تلبس لا تقتضي التحقيق والتوقيف للنظر. Abstract: Algerian courts have suffered from the large number of cases before them, which resulted in a slowness in the pace of referral and adjudication of cases procedures, which made the Algerian legislator hasten to adopt criminal procedures that speed up those procedures in order to reduce the number of cases submitted to the criminal judiciary, as well as simplifying procedures in order to speed up their broadcasting them. In the same context, the system of immediate appearance was introduced under Order No. 15-02, amending and complementary to the Code of Criminal Procedures, which came with a sentence of the basic provisions in the conduct of the criminal judiciary and the conduct of public proceedings, aimed at shortening the duration of litigation, shortening time and effort, simplifying procedures, and avoiding unjustified imprisonment periods, when the harem is complete and the pillars and the perpetrator is in a state of confusion that does not require investigation and arrest for consideration.
