الملخص
الملخص: تروم هذه المقالة إبداء ومضات من مرونة المؤسسة القضائية عند المدرسة المالكية الأندلسية، وتحاول وصف انفتاحها، وتفعيلها لآلية الاجتهاد وإحيائه، ودورها البارز في تجديد الفقه، وجعله حيويا ولصيقا بحياة الناس، يتحرك بحركتها، وتتنوع أحكامه تبعا للأعراف والتقاليد والأزمنة والأمكنة، وتهدف إلى إظهار ما تميز به نظام هذه المؤسسة وإنتاجها من خصائص تبرز نضج العقل الفقهي في القطر الأندلسي، وميوله إلى النظر والتفكير والواقعية. Abstract This article aims to show glimpses of the flexibility of the judicial institution according to the Maliki Andalusian School and attempts to describe its openness, its activation of the mechanism of diligence and its revival. This article explains its prominent role in renewing jurisprudence, making it vital and relevant to people’s lives, moving with its movement, and whose rulings vary according to customs, traditions, times and places. It also attempts to show what the system and production of this institution were distinguished by characteristics that highlight the maturity of the jurisprudential mind in the Andalusian country and its inclinations to theorizing, thinking and realism.
