مقاصد الوقف وأثره في التنمية

الملخص
يهدف هذا البحث إلى تبيان المقاصد الأساسية من الوقف الإسلامي، وتسليط الضوء على وظائف الوقف المختلفة التي لها صلة بالمقاصد الشرعية، لينبني عن ذلك تطوير الوقف الإسلامي وتجديده بما يتلاءم مع المتغيرات، فدراسة الوقف ومقاصده في ضوء حاجيات المجتمع الضرورية والتحسينية يعد مهما وجديرا بالدراسة والتأصيل، فإن مقاصد الشريعة الإسلامية هي الهدف الأسمى الذي يسعى الشارع لإبرازها، والتي بها تتحقق مصالح العباد في الدنيا والآخرة، ثم يتفرع عن ذلك بيان تأثير الوقف في مختلف المجالات المختلفة، الدينية والاجتماعية والاقتصادية وغيرها، فهو يسهم في العملية الانتاجية ويوفر مناصب شغل، كما يخفف من أعباء الدولة اتجاه الرعية، فللوقف دور بارز وجلي في تكافل أفراد المجتمع الإسلامي والاستثمار، وتخفيض الفوارق الاجتماعية والطبقية، ويدل على وجود صلة وصل وثيقة بين ماضي الأمة وحاضرها ومستقبلها. وركز الباحث على ضرورة إحياء دور مؤسسة الوقف الإسلامي على كل الأصعدة وخاصة الصعيد الاجتماعي، وما يتطلبه ذلك من تشخيص علمي واقعي متزن على الأملاك الوقفية، لتستأنف دورها الحقيقي الحضاري والاجتماعي. Abstract This research aims to clarify the primary objectives of Islamic endowments (waqf) and highlight its various functions that relate to the higher objectives of Islamic law (maqasid al-sharia). This study further seeks to develop and renew the Islamic waqf system in a way that aligns with changing societal needs. Understanding the waqf and its objectives in light of the essential and enhancing needs of society is crucial and worthy of scholarly attention. The objectives of Islamic law are the supreme goal that the lawgiver aims to highlight, as they are the means through which the interests of individuals are achieved both in this world and the hereafter. The research then explains the impact of waqf in various fields, including religious, social, and economic domains, among others. It contributes to the production process, provides job opportunities, and alleviates the burdens on the state concerning its citizens. Waqf plays a prominent and clear role in the solidarity of the Muslim community, investment, and in reducing social and class disparities. It signifies a strong connection between the past, present, and future of the nation. The researcher emphasizes the necessity of reviving the role of the Islamic waqf institution on all levels, especially in the social sphere, requiring a balanced, scientific, and realistic assessment of waqf properties so that they may resume their true civilizational and social role.
