الملخص: تهدف هذه الدراسة إلى الوقوف عند حقيقة علم مقاصد الشريعة، وعلاقتها بعلم القواعد الفقهية خاصة منها المتعلقة بالسياسة الشرعية، وذلك ببيان حقيقة علم القضاء الشرعي وتخصيص الدراسة بباب الدعاوى وما يتعلق بها من القواعد الفقهية الخاصة بالدعوى، والمدعي، والبينة والمدعى عليه، مع بيان علاقة مقاصد الشريعة وأثرها عليها من أجل بيان أن علماء القضاء كابن فرحون المالكي وغيرهم من القضاة يستندون في مسائل القضاء على الحفاظ على مقاصد الشريعة وليس اتباع الهوى. Abstract: This study aims to examine the truth about the science of the objectives of Islamic Sharia law, and its relationship to the science of jurisprudential rules, especially those related to Sharia policy, by explaining the truth about the science of Sharia jurisprudence and dedicating the study to the chapter of lawsuits and the jurisprudential rules related to it regarding the lawsuit, the plaintiff, the evidence, and the defendant. With an explanation of the relationship between the objectives of Sharia law and its impact on it, in order to show that judicial scholars such as Ibn Farhun al-Maliki and other judges rely in matters of judiciary on preserving the objectives of Sharia law and not following whims.
