Abstract: States adopt one of two judicial systems in their legal framework: the unified judicial system, which does not distinguish between different types of disputes, meaning that all disputes are subject to the same body of law applied to individuals (such as civil law, commercial law, and property law) and adjudicated by the same judiciary, whether the parties involved are private individuals or whether the dispute involves the administration and individuals; On the other hand, some states adopt a completely different system- the dual judicial system- which differentiates between disputes involving public administration and those that do not. In this system, disputes in which the administration is a party fall under the jurisdiction of administrative courts, while disputes that do not involve the administration are handled by ordinary courts ;The Algerian legislature adopted this dual judicial system in 1996, after having followed the unified judicial system for over three decades. To implement this system, certain criteria must be met to determine the competent judicial authority for a given dispute and, consequently, the most appropriate legal rules to apply. As a general rule, the Algerian legislature relies on a legislative or organic criterion to define the entities whose involvement in a dispute grants jurisdiction to the administrative courts. However, this is not the sole criterion used to determine the competence of these courts. As an exception, the legislature also applies a substantive or material criterion that focuses on the nature of the activity in question and its connection to the public interest
