مبدأ السيادة وأثره على تنفيذ الأحكام الجنائية الدولية و الأجنبية

الملخص
: تعتبر السيادة من الأفكار التي يقوم عليها القانون الدّولي المعاصر، والركيزة التي تقوم عليها الدولة الحديثة، إلّا أنّ التشبث بأهداب هذه الفكرة على إطلاقها وقف عثرة في طريق تنفيذ الأحكام الجنائية الأجنبية والدولية، ممّا حتّم على أشخاص المجتمع الدّولي التّخلي عن بعض الأفكار التقليدية المرتبطة بالسيادة مدفوعين بحتميات يفرضها الواقع، وتكريس تعاون دولي يغلّب المصلحة الجماعية على مصلحة الدّولة منفردة، وذلك من خلال العمل على تفعيل آليات تسهل تنفيذ العقوبات الجنائية مهما كان مصدرها إعمالا لحق المجتمع الدّولي في العقاب و ذلك من خلال التخلي عن المفهوم المطلق للسيادة الى المفهوم المرن. Abstract: Sovereignty is considered one of the ideas on which contemporary international law is built and the foundation on which the modern state is built. However, the clinging to this idea create a great obstacle in the way of executing foreign and international criminal judgements, Which forced members of the international community to abandon some traditional ideas related to sovereignty, driven by imperatives imposed by reality.and to Establish an international cooperation that gives priority to the collective interest over the interest of the individual state., by working to activate mechanisms that facilitate the implementation of criminal penalties, regardless of their source, preserving the international community’s right of punishment...
