الملخص
ملخص: منذ تنفيذ فرنسا أول تفجير نووي في 13 فيفري 1960 في منطقة "رقان"، الحدث الذي ولد معضلة حقيقية على المستويين السياسي والقانوني، دون تحييد التأثيرات الراديولوجية المستمرة على السكان والبيئة. تبعا لذلك تهدف الدراسة إلى تقديم إحاطة بالبرنامج النووي الفرنسي مع الوقوف على طبيعة التفجيرات المنفذة، كما هدف البحث إلى تبيان تأثير التفجيرات على الإنسان والبيئة في إطار يسمح ببناء رؤية قانونية. ولتحقيق أهداف البحث تم الاعتماد على مجموعة من المناهج والمقاربات البحثية كالمنهج التاريخي، المقترب القانوني، ومنهج دراسة حالة. في هذا السياق توصل البحث إلى جملة من التوصيات والنتائج ركزت في مجملها على ضرورة التحسيس بمخاطر التجارب النووية والتلوث الإشعاعي، كما طرح البحث الأدوات السياسية " التفاوض"، كبديل أكثر فعالية لإلزام الطرف الفرنسي بإعادة تأهيل المناطق الملوثة مع ضرورة تسليم الخرائط الخاصة بمواقع التفجير وأماكن ردم النفايات. Abstract: Since February 13, 1960, the date of the first French nuclear explosion in the region of Reggane, this event has posed a significant dilemma at both political and legal levels, particularly due to the unmitigated radiological effects on the population and the environment. This study aims to investigate the French nuclear program, understand the nature of the explosions, and explore methods to estimate their impacts on humans and the environment, with the goal of adapting a legal perspective. To achieve these research objectives, several methodologies were employed, including historical analysis, legal examination, and case studies. The research offers recommendations focused on clarifying the risks associated with nuclear explosions and radioactive contamination. Additionally, it suggests negotiation as the most effective approach to compel the French government to rehabilitate polluted areas, disclose maps of explosion sites, and manage waste dumping.
