Abstract: Testimony is the second most significant means of judicial proof after confession, if not the foremost, due to its widespread use among people throughout history. Maliki scholars have classified testimony into various categories to facilitate its application by judges and litigants. Among these categories is hearing testimony, which stands as a vivid example of the Malikis' profound understanding and assimilation of societal customs and the variability of human conditions. The Malikis were the most extensive among the Islamic schools of thought in applying and developing this form of testimony. It was established as a legitimate alternative to direct testimony, particularly in cases where evidence has become outdated or lost across various legal domains. Furthermore, although the Maliki jurists broadened its scope, they meticulously regulated it with stringent conditions. These conditions ensure that a discerning and just observer acknowledges their expansion as a product of refined jurisprudential reasoning rather than laxity or undue leniency.
