نظام الشكاوى الفردية كآلية لتطبيق الاتفاقية الأوروبية لحقوق الإنسان

الملخص
يعتبر نظام الشكاوى الفردية آلية رئيسية لضمان الامتثال لأحكام الاتفاقية الأوروبية لحقوق الإنسان، من خلال التطبيق الفعلي لنصوص هذه الاتفاقية، إذ تمكّن الأفراد من تقديم شكاوى مباشرة إلى المحكمة الأوروبية لحقوق الإنسان بشأن انتهاكات لحقوقهم الأساسية. بحيث يتيح هذا النظام للأفراد أن يكونوا مدعين أمام المحكمة، وبالتالي ضمان حقوقهم، والتصدي للانتهاكات بشكل فعّال. تسلط هذه الدراسة الضوء على مدى قدرة نظام الشكاوى الفردية على ضمان التنفيذ الفعلي للاتفاقية الأوروبية لحقوق الإنسان، بالتطرق لما جاء من نصوص ضمن الاتفاقية، وتعديلات بموجب البروتوكولات الملحقة بالاتفاقية الأوروبية بهدف إعادة تنظيم آليات المراقبة وتحسين فاعلية حماية حقوق الانسان، ودراسة آلية المحكمة الأوروبية لحقوق الانسان واجراءاتها فيها يتصل باختصاصها القضائي في الفصل الشكاوى الفردية. The individual complaints system is considered a key mechanism to ensure compliance with the provisions of the European Convention on Human Rights through the effective application of the Convention's texts. It enables individuals to directly submit complaints to the European Court of Human Rights regarding violations of their fundamental rights. This system allows individuals to act as plaintiffs before the court, thereby ensuring their rights and effectively addressing violations. This study highlights the extent of the individual complaints system's ability to ensure the actual implementation of the European Convention on Human Rights. It delves into the texts within the Convention and amendments made through protocols attached to the European Convention aimed at reorganizing monitoring mechanisms and improving the effectiveness of human rights protection. The study also examines the European Court of Human Rights' mechanism and procedures, particularly concerning its judicial jurisdiction in handling individual complaints.
