الملخص

ملخص : تتعلق هذه الدراسة بدور شركات التصنيف البحري في ضمان سلامة السفن وحماية البيئة البحرية ضمن إطار قانوني دولي معقد، خصوصًا في العلاقة بين دول العلم وهذه الشركات عبر عقد التفويض. تكمن أهمية هذا الموضوع في تأثير شركات التصنيف في الحفاظ على معايير السلامة البحرية والتقليل من المخاطر البيئية الناتجة عن النقل البحري. كما أن الدراسة تسلط الضوء على دور هذه الشركات في تطبيق المعايير الدولية مثل SOLAS وMARPOL، التي تساهم في ضمان سلامة السفن والتقليل من التلوث. تهدف دراستنا إلى تحليل الدور الحيوي الذي تقوم به شركات التصنيف في مجال الامتثال للمعايير الفنية والتشغيلية، وتحديد التحديات التي تواجهها في إطار الرقابة القانونية الدولية. كما تسعى الدراسة إلى تقديم حلول واقتراحات من شأنها تعزيز فعالية هذا الدور وتحسين النظام الرقابي لضمان تطبيق المعايير البيئية والسلامة البحرية بشكل أكثر فعالية، بما يتماشى مع التطورات الحديثة في القطاع البحري. الكلمات المفتاحية: السلامة البحرية؛ دولة العلم؛ شركات التصنيف. Abstract: This study focuses on the role of maritime classification societies in ensuring vessel safety and protecting the marine environment within a complex international legal framework, particularly in the relationship between flag states and these societies through delegation contracts. The significance of this topic lies in the impact of classification societies on maintaining maritime safety standards and reducing environmental risks associated with maritime transport. The study also highlights the role of these societies in implementing international standards such as SOLAS and MARPOL, which contribute to ensuring vessel safety and reducing pollution. Our study aims to analyze the critical role played by classification societies in ensuring compliance with technical and operational standards, as well as identifying the challenges they face under international legal oversight. The study also seeks to provide solutions and recommendations that enhance the effectiveness of this role and improve the regulatory system to ensure more effective enforcement of environmental and maritime safety standards in alignment with recent developments in the maritime sector.
