النظام القانوني الدولي لضمان استخدام الطاقة النووية في الأغراض السلمية International Legal System To Ensure Nuclear Energy Use In Peaceful Purposes

الملخص
تنــاولت هَـذه الدِراسة النِظــام القـانُوني الدولـي لِضمـان استِخدام الطـاقة النووِيـة فِي الأغـراض السلمِيـة، باعتبـارهـا مَسألـة تحظَّى باهتِمام المجتَمع الدُولـي نظَرا لمَا تُشكِله الأسلحَة النـَّووِيـة مِن مَخاطر تهدد الأمن والاستِقرار الدولِـييـن، بَل وتهدد الإنسانية بأكملِها، وقد اتَّجه المُجتمع الدولـي إلى إبرام العَديد مِن الاتِفاقيـات والمُعاهدات الدُولِية على المُستَوى العَالمـي والإقلِيمـي والثُنائـي، والتـي ساهَمت فـي إرسَـاء قواعِد قانـونـِية تهدفُ إلـى ضَمان الاستِخدام الآمِن والسلمـي للطـاقة النــووِية ومَنع انتِشار الأسلِحة النـووِية، ومَع ذلك فَإن التحدِيـات لا تزالُ قَـائمة خاصَّة في ظل التَّطور التِكنـولـوجي المُتسـارع وتبـايُن المصَـالح بَين الدول. وعَليْه يُعدُّ تعزِيز التَعـاون الدولـي وزِيادة الشَفافية مِن خِلال آلِيات رِقابية فعّالة أمرًا ضروريًا لِضمان نَجاح هذا النِظام القـانونِـي، وتتولى عدَّة هيئَـات ووكَالات دولِية وإقلـِيمـية مسؤُولية الإشرَاف على هذا الَمجال، مِن بَينها الوكَـالة الدولِـية للطـاقة الذرِية، لجنَة الطاقة الذرِيـة، لجنَة نَزع السِلاح، الوكَالة الأوروبِية للطاقة النـووِيـة (اليُوراتوم)، مُنظمة تَحريـم الأسلحة النـووِيـة في أمريكا اللاَتينية، والهيئَة العَربية للطاقة الذرِيـة. ويَظل التنسِيق بَين هَذه الجهـات، إلى جَـانب امتِثـال الدول للالتِزامـات الدولِية عُنصرًا أسـاسيـًا لتعزِيز الأمن النـووي العَالمي وضَمان الاستِخدام الآمِن والمَسؤُول للطَاقة النـووِية. Abstract: This study dealt with the international legal system to ensure the use of nuclear energy for peaceful purposes, as it is an issue that has the attention of the international community due to the dangers of nuclear weapons that threaten international security and stability, and even threaten all humanity, and the international community has tended to conclude many international agreements and treaties at the global, regional and bilateral levels, which contributed to establishing legal rules aimed at ensuring safe and peaceful use For nuclear energy and the prevention of the spread of nuclear weapons, however there are still existing challenges, especially in light of the accelerated technological development and the contrast of interests between states. Accordingly, strengthening international cooperation and increasing transparency through effective monitoring mechanisms is necessary to ensure the success of this legal system, and several international and regional bodies and agencies are responsible for overseeing this field, including the International Atomic Energy Agency, Atomic Energy Committee, the Disarmed Commission, the European Nuclear Energy Agency (uratom), the Organization for Nuclear Weapons in Latin America, and the Arab Atomic Energy Authority. Coordination between these bodies, as well as state compliance with international obligations, remains an essential element for strengthening global nuclear security and ensuring safe and responsible nuclear energy
