الخطأ الرياضي والمسؤولية الجزائية في التشريع الجزائري

الملخص: تمتاز الممارسات الرياضية بنبل الصفات وجميل أثرها على صحة الرياضي وعلى المجتمع بنشر محاسن السلوك ونبذ الآفات، إلا أنها تحيد أحيانا نتيجة ارتكاب الرياضيين لأفعال عنف في حدود قواعد اللعبة أثناء ممارستهم الرياضة تسمى أخطاء تقنية وتوقع بشأنها جزاءات تأديبية على مرتكبيها، دون أن تتجاوزها إلى المساءلة الجزائية باعتبارها أفعال تندرج ضمن الاستثناء على التجريم المتمثل في أسباب الإباحة لا سيما ما أذن به القانون وحالة رضا المجني عليه أو ما يعرف بقبول المخاطر، ما دامت هذه الأفعال في إطار حدود اللعبة والتصرف التنافسي المعتاد؛ لكن عنف الرياضي أحيانا قد يتجاوز التصرف التنافسي المعتاد وحدود اللعبة فيصبح خطؤه غير تقنيٍ ويخرج فعله من دائرة الاستثناء ويعود إلى الأصل أو القاعدة العامة ألا وهو تجريم العنف ويصبح بذلك مسؤولا عن فعله جزائيا وغير محمي بغطاء الإباحة. Abstract: Sports practices are distinguished by their noble qualities and their beautiful impact on the athlete's health and on society by spreading good behavior and rejecting evils, However, they sometimes deviate as a result of athletes committing violent acts within the rules of the game while practicing sports, These acts are called technical fouls and disciplinary penalties are imposed on the perpetrators, without going beyond them to criminal accountability, as they are acts that fall within the exception to criminalization represented by the reasons for permissibility, especially what is permitted by law and the state of the victim's consent or what is known as accepting risks, as long as these acts are within the limits of the game and normal competitive behavior; However, the athlete's violence may sometimes exceed normal competitive behavior and the limits of the game, so his error becomes non-technical and his act is removed from the circle of exception and returns to the origin or general rule, which is the criminalization of violence, He thus becomes criminally responsible for his act and is not protected by the cover of permissibility. Résumé: Les pratiques sportives se distinguent par leurs nobles qualités et leur bel impact sur la santé de l'athlète et sur la société en diffusant les bons comportements et en rejetant les maux, Cependant, il arrive que des écarts surviennent lorsque des sportifs commettent des actes de violence dans les limites des règles du jeu lors de la pratique d'un sport, On les appelle fautes techniques et des sanctions disciplinaires sont imposées à leurs auteurs, sans aller au-delà de la responsabilité pénale, car il s'agit d'actes qui relèvent de l'exception à la criminalisation représentée par les motifs de permissibilité, notamment ce que la loi a permis et l'état de consentement de la victime ou ce que l'on appelle l'acceptation des risques, à condition que ces actes restent dans les limites du jeu et du comportement compétitif normal. Cependant, la violence de l'athlète peut parfois dépasser le comportement compétitif normal et les limites du jeu, de sorte que son erreur devient non technique et son action sort du cercle de l'exception et revient à l'origine ou à la règle générale, qui est la criminalisation de la violence, et il devient ainsi pénalement responsable de son action et n'est pas protégé par le couvert de la permissibilité.
