Rulings On Liability Lawsuits: Legal Framework Of The Land Transport Contract

Abstract
passenger in land transport, the aggrieved party initiates legal action through a lawsuit adhering to legal conditions and procedures. The Algerian legislator has codified specific procedures for liability lawsuits against carriers under transport contracts, requiring claimants to undertake prescribed actions within specified timeframes to prevent claim dismissal. يلجأ المتضرر في عقد النقل البري إلى استعمال حقه في المطالبة القضائية بالتعويض عن الضرر اللاحق به بسبب الخسائر والأضرار التي أصابت بضاعته إذا كان مرسلا أو أصابته هو باعتباره مسافرا متنقلا برا بحيث تتخذ هذه المطالبة شكل الدعوى التي ترفع حسب الشروط والأوضاع المقررة قانونا، ولقد اهتم المشرع الجزائري بموضوع دعوى المسئولية التي ترفع على الناقل بمناسبة تنفيذ عقد النقل فنص على إجراءات معينة يجب على رافع الدعوى اتخاذها خلال مواعيد محددة حتى لا ترفض.
