دور مبدأ الملوث الدافع في الوقاية ومنع الضرر البيئي

الملخص
يعتبر موضوع البيئة من بين المواضيع التي كانت ولا تزال محور اهتمام المجتمع الدولي، نتيجة للمخاطر التي تتعرض لها البيئة بمختلف عناصرها سواء من حيث آثار التلوث أو بفعل الاستنزاف، مما خلق نوع من اللاأمن على الجيل الحالي و الأجيال اللاحقة، أين تم التفكير بضرورة الحفاظ على البيئة من خلال عقد المؤتمرات وإبرام الاتفاقيات والمعاهدات الدولية والإقليمية، وكان من بين مخرجات هاته الصكوك والمواثيق الدولية تبني المجتمع الدولي لمبادئ وتوصيات، تهدف إلى إيجاد حلول للحد أو للتقليل من الأضرار البيئية التي تتميز بخصوصية تختلف عن الأضرار العادية، فتم إقرار نظام المسؤولية المدنية للتعويض عن الأضرار البيئية التي وجدت أساسا لها في مبدأ الملوث الدافع. The ecological issue is one of the topics that has always been the crucial interest of the international community as well as at the national level and this is a result of the dangers to which the environment is exposed in its various elements, whether in terms of the effects of pollution or due to depletion, which created a kind of insecurity for the current generation and even for subsequent generations. for this, international conferences were held and regional agreements were made for the purpose of finding solutions to limit or reduce environmental damage, which is characterized by a specificity that differs from ordinary damage. thus, a system of civil liability was approved to compensate for environmental damage, which found its basis in the polluter principle.
