الاطار القانوني للاستثمار في الجزائر

الملخص
الملخص: الاستثمار هو قيام شخص طبيعي او معنوي باستخدام أمواله او قدراته في مشروع معين قصد تحقيق عائد مالي في المستقبل. وتتعدد أنواع الاستثمار حيث تصنف الى عدة فئات. وقد سعت الجزائر بهدف جذب الاستثمارات الى سن مجموعة من القوانين والتشريعات اهمها قانون الاستثمار (2016) الذي يوفر حوافز واعفاءات ضريبية بالإضافة الى الاتفاقيات الدولية التي ابرمتها الجزائر في مجال الاستثمار. وأخيرا القانون 22/18 المتعلق بالاستثمار حيث سعت من خلاله الدولة إلى تفعيل خطة محكمة للإنعاش الاقتصادي و ذلك من خلال استحداث آلية مستقلة فعالة تتولى الفصل في الشكاوي والطعون المقدمة من قبل المستمرين الى جانب هيكلة الوكالة الوطنية لتطوير الاستثمار والتي تغير اسمها إلى الوكالة الجزائرية لترقية الاستثمار لتصبح آلية تنفيذية لقانون الاستثمار ووسيلة ضرورية للنهوض بالقطاع الاستثماري و ذلك مع مراعاة المشرع الجزائري للتغيرات الاقتصادية و السياسية التي تمر بها الجزائر. Abstract: Investment is the use of a natural or legal person in a specific project in order to achieve a profit that may be alone or with another person who can be a national or foreign person and a project can also be established with the state. Investment has multiple forms, including direct and indirect investments, as well as national investments and foreign investments, in addition to industrial and commercial investments. In order to enhance the business environment and attract investments, Algeria has sought to enact a set of laws and legislations, the most prominent of which is the Investment Law (2016), which provides incentives and tax exemptions, in addition to Law 51/49, which determines the percentage of foreign ownership in projects. Finally, Law 22/18 on investment, through which it sought to activate a solid plan for economic recovery through the creation of an independent high-level mechanism to adjudicate complaints and appeals submitted by the continuors, in addition to structuring the National Agency for Investment Development and changing its name to the National Agency for Investment Promotion to become an executive mechanism. The investment law is a necessary tool for the advancement of the investment sector within the framework of the adaptation of the Algerian legislator to the economic changes and the social and political situation that Algeria is going through.
