الملخص
ينعكس تكييف الشفعة على أحكامها المميزة وكذا أثارها على المراكز القانونية لأطرافها ؛ حيث تُحِل الشفيع محل المشتري ولو جبرا، ودون رضاه في عقد البيع، بينه وبين البائع المجبر أيضا على التعاقد مع شخص غير الذي ارتضاه، والشفيع لم يَسلم بدوره، حيث يجبر هو الآخر على تنفيذ عقد لم يوافق على شروطه ولم يشارك في وضعها حتى، هذا ما يتنافى وقاعدة حرية التصرف .
