الأسس القانونية لتدخل الدولة في المجال الاقتصادي في ظل اقتصاد السوق

الملخص
يختلف حجم تدخل الدولة في النشاط الاقتصادي حسب النظام الاقتصادي المتبع في كل دولة، ففي الجزائر التي اعتمدت نظام اقتصاد السوق في أواخر الثمانينيات، انتقل دور الدولة فيها من التدخل المباشر إلى دور يرتكز على الضبط والإشراف على الأنشطة الاقتصادية ، ورغم الاعتراف الصريح بمبدأ حرية التجارة والاستثمار، وإحلال سلطات الضبط الاقتصادي مكان الدولة، فإن ذلك لم يؤدي إلى انسحاب الدولة بشكل كامل من المجال الاقتصادي، تهدف الدراسة إلى تبيان دواعي تدخل الدولة في النشاط الاقتصادي، التي تحتفظ بدور وإن كان محدوداً في التدخل مستندة في ذلك لمجموعة من المبررات أهمها ضمان حماية المستهلك وتوفير بيئة تنافسية حرة وعادلة ومكافحة الاحتكار، مع استعراض بعض أشكال هذا التدخل المتمثل في تمويل المؤسسات العمومية الاقتصادية والمؤسسات الصغيرة المتوسطة وإضفاء الشرعية القانونية عليه ، وتخلص الدراسة إلى أن تدخل الدولة ضروري لتلبية الاحتياجات العامة وتحقيق الاستقرار الاجتماعي والاقتصادي The degree of the state intervention in the economy varies according to the state economic system. In Algeria, which has adopted the market economy in the late 1980s, the state's role changed from the direct intervention to the supervision and regulation of the economic activities. Despite the explicit recognition of the principle of free trade and investment, and substituting the state intervention by the economic regulation authorities, the state did not completely withdraw from the economic field. Based on what was said, this study aims to explore the reasons for the state (limited) intervention in the economic field to protect the consumer and establish a free and fair competitive environment far from any monopoly. Besides, we shall show some aspects of the intervention, namely funding the public economic corporations and the small and middle-sized companies. In addition, we shall discuss how the intervention gets the legal nature. The study concludes that the state intervention is crucial for meeting public needs and achieving social and economic stability.
