Abstract: The general rule in enforcement is that judgments with res judicata authority are those that acquire enforceability, allowing for compulsory execution if the debtor refuses voluntary compliance. However, as an exception to this rule, a judicial judgment that has not yet fulfilled the necessary procedures to become immune to ordinary appeals can still acquire enforceability through provisional enforcement. This concept is stipulated in Article 323 of the Algerian Code of Civil and Administrative Procedure. In addressing this exception, the legislature sought to balance the interests of the judgment creditor benefiting from such enforcement and their specific circumstances by defining the cases and conditions required for a judgment to be deemed subject to provisional enforcement. These cases were identified based on justifications that warrant this exception. However, applying an exception to the general rule cannot occur without restrictions or without providing guarantees for the judgment debtor. Therefore, the legislature sought to safeguard the debtor's interests to prevent harm by introducing guarantees to limit the judgment creditor’s power. This approach aims to strike a balance between provisional enforcement as a legal necessity and the risk of abuse against the judgment debtor.
