الملخص
أضحت الوظيفة التشريعية بشكل عام والجزائية منها بشكل خاص تتسم بطابعٍ مميز في ظل الحركة النشطة والمتزايدة لما يعرف بالعولمة الجزائية، حيثُ أدى تطور الجريمة نتيجة التقدم التكنولوجي والتقني إلى ظهور صور مستحدثة من الإجرام، لعل أكثرها خطورة هي الجريمة المنظمة العابرة للحدود الوطنية، وهو ما يستدعي ضرورة تكثيف وتوحيد جهود المجتمع الدولي لمكافحة هذا النوع من الإجرام، وهو ما حدث بالفعل من خلال عولمة القانون الجزائي عبرَ تدويل مصادر القاعدة الجزائية، وذلك بالاعتماد على أهم الأليات القانونية للعولمة الجزائية، ألا وهي الاتفاقيات الدولية الجزائية التي أحدثت تحولاً جوهرياً في المفهوم التقليدي للوظيفة التشريعية الجزائية، ومقومات مبدأ الشرعية الجنائية. وعليه، يهدف هذا العمل دراسة مظاهر التحول في الوظيفة التشريعية الجزائية في ظل العولمة الجزائية المعاصرة، وفي ضوء استقراء بعض النصوص الدستورية الجزائرية ذات الصلة بالموضوع والمدرجة بدستور 2020. The legislative function, in general, and the criminal legislative function, in particular, have acquired a distinctive character amidst the active and increasing movement known as penal globalization. The evolution of crime due to technological and technical advancements has led to the emergence of new types of crime, notably the most dangerous of which is organized crime that transcends national borders. This necessitated the intensification and unification of international community efforts to combat such crimes, which indeed materialized through the globalization of criminal law by internationalizing the sources of criminal norms. This was achieved by relying on the most significant legal mechanisms of penal globalization, namely international criminal conventions. These conventions have fundamentally transformed the traditional concept of the criminal legislative function and the elements of the principle of criminal legality. Accordingly, this work aims to study the manifestations of the transformation in the criminal legislative function in the context of contemporary penal globalization, in light of the analysis of some relevant Algerian constitutional texts amended in 2020.
