التدخل الإنساني المسلح والشرعية الدولية

الملخص
تمثل ظاهرة التدخل الإنساني انعكاسا لمدى تطوّر العلاقات الدولية في مقابل زيادة الاهتمام بحقوق الإنسان، الأمر الذي يبين زيادة الوعي الإنساني لدى المجتمع الدولي بضرورة حماية الوجود الإنساني ، كونه أساس استمرار دورة الحياة و يمكن التأكيد على شيء واحد في خصوص التدخل الإنساني وهو أنّه ما من مبدأ قانوني حتى مبدأ السيادة نفسه لا يمكن أن يحمي الجرائم المرتكبة ضد الإنسانية، فحين ترتكب هذه الجرائم وتستنفذ المحاولات السلمية الرامية إلى وقفها، يكون على المجتمع الدولي واجب أخلاقي بأن يتصرف ويوقف هذه الجرائم بالقوة، أي التدخل المسلح. The phenomenon of humanitarian intervention is a reflection of the development of international relations in exchange for an increase in the interest in human rights, which shows the increase in the human awareness of the international community of the need to protect human existence, being the basis of the continuation of the life cycle, and one thing can be emphasized about humanitarian intervention, which is that there is no principle Legal, even the principle of sovereignty itself cannot protect crimes against humanity. When these crimes are committed and peaceful attempts to stop them are exhausted, the international community has a moral duty to act and stop these crimes by force, that is, armed intervention.
