مدى جدية الحماية القانونية لمواجهة الاضرار بالبيئة قبل انعكاسها السلبي على الأنسان والتنمية

الملخص
أضحت البيئة وما تتعرض له من ملوثات صناعية بفعل ما يقوم به الإنسان من أعمال وصناعات، لما تنفثه هذه الأعمال والأفعال من مخلفات كيماوية، تشغل حياة الإنسان في العصر الحالي، وذلك بهدف تدارك خطورة ما تطلقه الحروب والصناعات الكيماوية في الهواء، من غازات سامة مؤثره بصورة أو بأخر في التحولات البيئية، فأظهرت نوع غير معتاد من المستويات والتغيرات في أنماط الحالات المناخية المتغيرات للطقس، مما ازداد ارتفاع في منسوب سطح البحر، وهواء الغلاف الجوي، وحرائق الغابات، من سموم تنذر بخطورة بيئية وصحية، بصورة مختلفة وخطيرة عن مستوياته السابقة، وهذا ما دفعنا في البحث والتركيز على هذه التحولات والتحديات في عوامل البيئية، نحو إظهار خطورتها مع الذين سبقونا في وضع المشكلات البيئية أمام الفاعلين والمؤثرين بضرورة معالجة الخطورة المحدقة بالكوكب الذي يعيش عليه الإنسان والكائنات الحية وغير الحية من الانعكاسات السلبية قبل فوات الآوان. حيث حاولنا من خلال محورين وفقراتهما: تناولنا في أولهما: عوامل التأثير في الإخلال بالتوازن البيئي والمؤثرات المضرة بالبيئة الطبيعية، فتم التركبزعلى إزالة الغابات بالحرق أو القطع وتحويل معظم الأراضي الزراعية والمساحات الخضراء، إلى مساكن عمرانية، من ناطحات سحاب ومصانع مختلفة منها ملوثاتها مضرة بالحياة، بهدف الربح، والمضاربات التجارية، والصناعية المختلفة، بهدف النفوذ والسيطرة على حساب البيئة الطبيعية، ثم تناول في ثانيهما: ماهي آليات التنفيذ القانونية الوطنية والدولية، الهادفة نحو صون الحياة، ومنع ومكافحة، ومعالجة هذه الظواهر الخطيرة على البيئة، وحياة الكائناتها الفطرية، بما فيها صحة وحياة الإنسان قبل تدهورها. The environment and the industrial pollutants it faces due to human activities and industries have become a central concern in modern times. These activities release chemical waste that significantly impacts the atmosphere, particularly through the toxic gases emitted by wars and chemical industries. These emissions contribute to environmental transformations, leading to unprecedented changes in climate patterns, rising sea levels, atmospheric pollution, and forest fires. These toxins pose severe environmental and health risks, surpassing previous levels of concern. This study aims to examine these environmental transformations and challenges, emphasizing their severity. It builds on previous research that has identified environmental problems, urging key stakeholders to address the imminent dangers threatening the planet and all living and non-living entities before it is too late. The study is structured around two main axes. The first explores the factors contributing to environmental imbalance and the harmful effects on the natural environment. It highlights deforestation—whether by burning or logging—alongside the conversion of agricultural lands and green spaces into urban developments, including skyscrapers and factories. Many of these industries release pollutants harmful to life, often driven by profit motives, industrial expansion, and commercial competition at the expense of the natural environment. The second axis examines national and international legal mechanisms designed to protect life, prevent environmental degradation, and combat these hazardous phenomena. It explores policies and legal frameworks aimed at preserving the environment, protecting wildlife, and safeguarding human health before irreversible damage occurs.
