تنميط شخصية الجاني بين الفاعلية ومحدودية النتائج Profiling The Offender Between Effectiveness And Limited Results

الملخص
إن الهدف الأول من التحقيق هو الكشف عن شخص الجاني الذي ارتكب الجريمة لتقديمه للمحاكمة، لكن مسرح الجريمة لا يتوافر دائما على المعطيات اللازمة التي قد تمكن المحقق من الوصول للحقيقة، فرغم التقنيات الحديثة للتحقيق الجنائي الكلاسيكي غير أن العديد من الجرائم تبقى دون حل ويظل المجرم مجهولا، وهو الأمر الذي يدفع المحققين للجوء لطرق أخرى تتمثل في تحليل سلوك المجرم من خلال الكيفية التي ارتكب بها الجريمة والساعة التي اختارها والمكان الذي ارتكب فيه جرمه وأشياء كثيرة أخرى كله بهدف الوصول لتحديد ملامح شخصية الجاني والوصول إليه في النهاية، العديد من الدول تعتمد هذا الأسلوب لمساعدة المحققين في التحقيق لكن رغم ذلك تبقى الجزائر بعيدة عن مجال التنميط الجنائي، من خلال موضوعنا سنحاول الكشف ولو قليلا على أهمية عملية تنميط شخصية الجاني وهل بالفعل تعطي النتائج المرجوة منها لنرى في النهاية إذا كان المشرع قد أحسن باستبعاده لعملية التنميط الجنائي كوسيلة للتحقيق أم يجب ربما الأخذ بذلك. The primary goal of the investigation is to uncover the identity of the perpetrator who committed the crime in order to bring him to trial, but the crime scene does not always have the necessary data that may enable the investigator to reach the truth. Despite the modern techniques of classical criminal investigation, many crimes remain unsolved and the criminal remains unknown, which prompts investigators to resort to other methods represented in analyzing the criminal's behavior through how he committed the crime, the time he chose, the place where he committed his crime and many other things, all with the aim of determining the characteristics of the perpetrator's personality and reaching him in the end. Many countries adopt this method to help investigators in the investigation, but despite that, Algeria remains far from the field of criminal profiling. Through our topic, we will try to reveal, even a little, the importance of the process of profiling the perpetrator's personality and whether it actually gives the desired results, so that we can see in the end whether the legislator did well by excluding the criminal profiling process as a means of investigation or perhaps it should be taken into account.
