توظيف المصطلح الفقهي عند الشيخ خليل بن إسحاق الجندي من خلال كتابه ″المختصر‶

الملخص

ملخص: يُعَدُّ مختصر الشّيخ خليل بن إسحاق المالكي أهمّ المختصرات الفقهية المالكية، جمع أغلب ما تفرّق، ولم ينسج غيره على منواله، ولم نظفر عند غيره بمثاله؛ لأجل هذا يسعى هذا البحث إلى بيان المصطلحات التي وظّفها الشّيخ خليل في هذا المختصر؛ لأن المصطلح مفتاح المعرفة. وقبل الشّروع في المقصود قدّم البحث نبذة موجزة عن حياة الشيخ؛ اسمه ونسبه، وشيوخه، وتلاميذه، ومؤلفاته، ووفاته، كما عرّف بالمختصر؛ سبب تأليفه، ومُدّة تأليفه، وثناء العلماء عليه، كما تطرق إلى معرفة الشّيوخ الذين اعتمدهم خليل في مختصره. يشير الشّيخ خليل بضمير الغائب للمدوّنة، حتى وإن لم يسبق لها ذكر؛ وذلك لشهرتها، ووظّف الشّيخ خليل لكلّ شيخ من الشّيوخ الذين اعتمدهم مصطلحا خاصًّا به؛ فخصّ اللخمي بالاختيار؛ لكثرة اختياراته والجُرأة عليه، وخصّ ابن يونس بالتّرجيح؛ لأنّ اجتهاداته تميل إلى أقوال العلماء الذين سبقوه، وخصّ ابن رشد بالظّهور؛ لاعتماده على ظاهر الرّوايات، وخصّ المازري بمصطلح القول؛ لأنّه كان صاحب قول يُعتمَد عليه، وخصّ غيرهم من الشّيوخ بمصطلح التّصحيح أو الاستحسان. Abstract : The summary of Sheikh Khalil bin Ishaq Al-Maliki is considered one of the most important Maliki abbreviations. It is a comprehensive collection. No weaver has woven its pattern, nor did Qurayha permit its example. Through this, this research seeks to clarify the terms used by Sheikh Khalil in this summary. Before embarking on that, the research explained the life of the Sheikh. His name and lineage, his sheikhs, his students, his writings, his death, and the research was also defined in brief; The reason for its composition, the duration of its composition, and the scholars’ praise of it. The research also touched on the knowledge of the sheikhs whom Khalil relied on in his summary. Sheikh Khalil refers to the code in the third person, even if it has not been mentioned before, due to its fame. Sheikh Khalil employed a special term for each of the sheikhs he relied on. He singled out Al-Lakhmi for selection, due to his many choices and boldness in doing so. He singled out Ibn Yunus for preference, because his efforts tended toward the statements of the scholars who preceded him. He singled out Ibn Rushd for appearance, due to his reliance on the apparent meaning of the narrations. He singled out Al-Mazari for the term saying, because he was the owner of a statement that could be relied upon. He singled out the other sheikhs for the term correction or approval.
