مدى إمكانية تطبيق القانون الدولي الإنساني على الاستخدامات العسكرية للذكاء الاصطناعي "دراسة تحليلية"

الملخص
تسعى الدراسة إلى بيان مفهوم أسلحة الذكاء الاصطناعي ومشروعية استخداماتها العسكرية، حيث أصبحت هذه الأسلحة من أهم سمات الحروب الحديثة. وتهدف الدراسة أيضًا إلى تسليط الضوء على مدى إمكانية تطبيق القانون الدولي الإنساني على استخدام الذكاء الاصطناعي في مجال التسليح العسكري. فمع استمرار تطور الذكاء الاصطناعي، فإنه يثبت بشكل متزايد الإمكانات الكامنة لتغيير توازن القوى العالمي والاستقرار الاستراتيجي، حيث أصبح استخدام تقنية الذكاء الاصطناعي في مجال التسليح العسكري فيما يُعرف بـ "الأسلحة ذاتية التشغيل" لها تأثيراتها الواقعية في النزاعات المسلحة، وهو ما يضفي تحولًا كبيرًا في مجال سير النزاعات المسلحة، حيث ستتحول الحروب التقليدية إلى حروب ذكية تعتمد على تطبيقات الذكاء الاصطناعي. الأمر الذي سيشكل "معضلة أمنية" كبرى في مجال العلاقات الدولية المعاصرة، فالاستخدام غير القانوني للأسلحة ذاتية التشغيل سيلحق أضرارًا أمنية خطيرة بالمجتمع الدولي، ومن هنا كان لابد من تضافر الجهود الدولية نحو تقييد صنع واستخدام تلك الأسلحة بحيث لا تتعارض مع القانون الدولي الإنساني. The study seeks to clarify the concept of artificial intelligence weapons and the legitimacy of their military uses, as these weapons have become one of the most important features of modern wars. The study also aims to shed light on the extent to which international humanitarian law can be applied to the use of artificial intelligence in the field of military armament. As artificial intelligence continues to develop, it is increasingly demonstrating the potential to change the global balance of power and strategic stability, as the use of artificial intelligence technology in the field of military armament in what is known as “autonomous weapons” has real-world effects in armed conflicts, which adds a major shift in The field of conduct of armed conflicts, Where traditional wars will turn into smart wars based on artificial intelligence applications. This will constitute a major “security dilemma” in the field of contemporary international relations, as the illegal use of autonomous weapons will cause serious security damage to the international community, and hence it is necessary to concerted international efforts to restrict the manufacture and use of these weapons so that they do not conflict with international humanitarian law.
