الملخص
لا ريب أنّ مسألة الثّبات والتّغيّر في الفقه السّياسي من القضايا ذات الأهمّية البالغة والتي تقتضي بذل الوسع في دراستها واستفراغ الطّاقة في تحريرها، لتقديم رؤية متوازنة تعين الأمّة على العيش سياسيا في ظلّ عقيدة الإسلام وشريعته؛ ذلك أنّ الفقه السّياسي بحاجة إلى تجديد كثير من قضاياه في ظلّ الأوضاع الرّاهنة ليستعيد جدّته، وينفض ما تراكم على أحكامه من غبار الرّكود الفكري الذي ساد ساحته منذ أمد طويل، وليكسر أغلال التّقليد التي تقيّد بها بعض الفقهاء ممّن يتحدّثون في الشّأن العامّ، وليدفع ما وجّهه إليه أعداؤه وخصومه من تُهَم الجمود والقصور عن ملاحقة تطوّرات الحياة السّياسية داخليا وخارجيا. هذا ولمّا كانت الحاجة ماسّة إلى دراسة تأصيلية وتشريعية لهذا الموضوع فقد جاءت هذه الدّراسة الموسومة بعنوان: "تطوّر الفقه السّياسي، مجال وجدال"، لتقف على مدى أهمّية الموضوع ومجاله، والجدل القائم حوله، وتحديد الأسباب الدّافعة إلى هذا التّطوير، مع بيان الأسس الواجب مراعاتها أثناء ذلك، وكذا تتبّع سيرورة هذا التّطوّر ومظاهره. There is no doubt that the issue of constants and variables in political jurisprudence is one of great importance, which requires extensive efforts in studying it and understanding its meanings, to provide a balanced vision that helps the nation to live politically under the doctrine of Islam and its Sharia; political jurisprudence needs to renew many of its provisions in light of the current situation in order to restore its vitality, and to shake off what has accumulated on its rulings from the intellectual stagnation that has dominated its arena for a long time, and to break the tradition by which some jurists limited themselves to speaking in public affairs, and to distance themselves from the accusations of rigidity and failure to keep pace with the developments of political life both internally and externally. Since there is an urgent need for a fundamental and legislative study of this topic, this study, titled: "The Evolution of political jurisprudence (Domain and Disputation)" aims to explore the significance of the topic and its scope, the ongoing debate surrounding it, and to identify the reasons driving this development, while outlining the principles that must be observed in this regard, as well as tracing the process and manifestations
