تفعيل دور الرقابة على تنفيذ عقد الشراكة بين القطاع العام والخاص

الملخص
الملخص: انتشر موضوع نظام الشراكة بين القطاعين العام والخاص مؤخرا لما له من أهمية في تنفيذ مشاريع البنية التحتية والتي تُعتبر أحد ركائز الاقتصاد, كذلك باعتباره حل للمشاكل التمويلية التي تواجهها الدولة في إنشاء المرافق العمومية و تخفيف الأعباء المالية الملقاة على عاتق الدولة في الأصل. إذ لا يُمكننا إنكار الدور الفعَّال للقطاع الخاص في إدارة المشاريع الاقتصادية الكبرى التي تحتاجها الدولة وتسعى لإنشائها وتنفيذها حتى تحقق التنمية الاقتصادية عن طريق الشراكة. ولنجاح الشراكة بين القطاع العام والخاص كان لابد من تفعيل الدولة لسلطتها الرقابية على تنفيذ هذه العقود الاقتصادية الكبرى, وفي ذات الوقت تعتبر العائق والعقبة أمام المستثمر الخاص في إدارته للمرفق العمومي موضوع الشراكة, مما يجعل الدولة في مواجهة حقيقية بين سلطتها في الرقابة على تنفيذ المستثمر لعقد الشراكة و حريته في إدارة مشروع الشراكة. Abstract The topic of the partnership system between the public and private sectors has become widespread recently because of its importance in implementing infrastructure projects, which is considered one of the pillars of the economy, as well as a solution to the financing problems that the state faces in establishing public facilities and alleviating the financial burden originally placed on the state. We cannot deny the effective role of the private sector in managing the major economic projects that the state needs and is unable to create and implement them in order to achieve economic development through partnership. For the partnership between the public and private sectors to succeed, it was necessary for the state to activate its oversight authority over the implementation of these major economic contracts, and at the same time it is considered a barrier and an obstacle to the private investor in his management of the public facility that is the subject of the partnership, which puts the state in a real confrontation between its authority to monitor on the investor’s implementation of the partnership contract and his freedom to manage the partnership project
