موقف القانون الجزائري من الاتفاق الجنائي في الجرائم السيبرانية

الملخص
تزداد خطورة الجريمة حينما ترتكب في قالب جماعي مبني على اتفاق جنائي مسبق، مما ينذر بتوسع دائرة الإجرام،وتتضاعف خطورته في الفضاء السيبراني، فهو يغذي الجرائم السيبرانية ويقويها،الأمر الذي فرض على بعض التشريعات تكييفه جريمة مستقلة إذ هو عزم يضاف إلى عزم الغير فتتحد الإرادة وتقوي بعضها لارتكاب الجرم،وهو ما أثار حفيظة المدافعين عن مبدأ الشرعية، مما جعلنا نقف على بعض معاييره و أركان تجريمه،و نستشف من خلالها موقف المشرع الجزائري الذي نحى نحوا مغايرا في تبني تجريمه إن كان غرضه جريمة سيبرانية باشتراطه أن يكون مجسدا بأعمال مادية. And it strengthens it, which imposed on some legislation to make it an independent crime, as it is a determination added to the determination of others, so the will unites and strengthens each other to commit the crime, which is what raised the ire of the defenders of the principle of legality, which made us look at some of its standards and pillars of its criminalization and understand through them the position of the Algerian legislator. Which took a different approach in adopting its criminalization if its purpose was a cybercrime
