The Constitutional Court was established by the 2020 constitutional amendment to replace the Constitutional Council, marking a shift in Algeria’s constitutional system to reinforce the rule of law. According to Article 192, the Constitutional Court was granted the authority to resolve disputes between constitutional powers, alongside its other responsibilities. This amendment aligns with global trends to ensure separation of powers and balance between authorities. Algeria’s constitutional experience revealed executive dominance over the legislature and overlapping powers between institutions, necessitating a neutral authority to ensure the proper functioning of constitutional bodies and resolve conflicts or deadlock.
