تنازع المركزية واللامركزية وأثره على استقلالية الجماعات المحلية في الجزائر (2011-2024)

الملخص

The article seeks to determine the position of local collectives within the organizational and functional structure of the administrative and political apparatus of the Algerian state by analyzing the relationship governed by the systems of centralization and decentralization and trying to find theoretical and practical answers and ways out of the accumulated decades of administrative and political practice of local collectives in Algeria since independence from the administrative and political dilemmas that the article identifies in the issue of the conflict between centralization and decentralization and its impact on the management of local collectives, which will be examined by analyzing the relationship that connects these regional collectives with the state and their relations with each other, and then trying to neutralize the organizational-administrative variables behind the issue at hand. This will be examined by analyzing the relationship between these local collectivities and the state and their relations with each other, then trying to neutralize the organizational-administrative variables that stand behind the issue at hand by analyzing the relationship between the elected politician and the appointed administrator, then deducing solutions and proposals that would respond to the requirements of the political, administrative, social, economic and technological transformations that Algeria is witnessing, especially given the maturity reached by various local bodies in our country, in addition to the need to keep pace with the constitutional contents affirmed by the 2020 Constitution, which are related to the embodiment of democracy locally and nationally, and the participatory and autonomous nature of this, based on the motives of the upcoming amendments to the municipal and wilaya laws during the current year. The study adopted an integrated methodology that combines a case study and a comparison, based on two approaches, one constitutional-legal and the other structural-functional. In the end, the study came up with a number of conclusions, mainly the need to make fundamental changes in the administrative system of the state, by reconsidering the distribution of roles and functions, expanding Validity and responsibilities in favor of institutions and limiting them to others, in addition to the need to adopt new formulas for the structures and functions associated with local collectives and their relations with each other and with the state. تبحث المقالة في تحديد مكانة الجماعات المحلية ضمن البنية التنظيمية والوظيفية للجهاز الإداري والسياسي للدولة الجزائرية، من خلال تحليل العلاقة التي تحكمها نظم المركزية واللامركزية ومحاولة إيجاد الإجابات والمخارج النظرية والعملية لما كرسه تراكم عقود من الممارسة الإدارية والسياسية التي خاضتها الجماعات المحلية في الجزائر منذ الاستقلال من مثالب ومعضلات إدارية وسياسية تحدّدها المقالة الحالية في إشكالية تنازع المركزية واللامركزية وتأثيرها على إدارة الجماعات المحلية، حيث سيتم بحث ذلك من خلال تحليل العلاقة التي تربط تلك الجماعات الإقليمية بالدولة، وعلاقاتها ببعضها البعض، ثم محاولة تحييد المتغيرات التنظيمية-الإدارية التي تقف وراء الإشكالية المطروحة، عبر تحليل علاقة السياسي المنتخب بالإداري المعيّن، مع الأخذ بعين النظر النضج الذي بلغته مختلف الهيئات المحلية في بلدنا، وما تفرضه ضرورة مواكبة المضامين الدستورية التي يؤكدها دستور سنة 2020، والمرتبطة بتجسيد الديمقراطية محليا ووطنيا، وما يقتضيه ذلك من تشاركية واستقلالية، مع الاستناد على دوافع التعديلات المرتقبة في قانوني البلدية والولاية خلال السنة الجارية. وتم اعتماد منهجية متكاملة تجمع بين دراسة الحالة، والمقارنة، وبالاستناد على مقاربتين احداها دستورية-قانونية، والثانية بنيوية وظيفية. وفي الأخير توصلت الدراسة إلى جملة من النتائج تتمثل أساسا في ضرورة احداث تغييرات جوهرية في المنظومة الإدارية للدولة، من خلال إعادة النظر في توزيع الأدوار والوظائف، وتوسيع الصلاحيات والمسؤوليات لصالح هيئات، وتقليصها وتحديدها لأخرى، إضافة إلى ضرورة تبني صيغ جديدة للبنى والوظائف المرتبطة بالجماعات المحلية وعلاقاتها ببعض البعض وبالدولة.
