عقد الامتياز في تسيير النشاطات المينائية وفقا للتشريع الجزائري

الملخص
الملخص تلعب النشاطات المينائية التجارية المقدمة للسفن دورا هاما في الرفع من حجم المبادلات التجارية الدولية، غير أن تمركز هذه الخدمات في يد السلطات المينائية أدى إلى تراجع مردوديتها ونقص في جودتها نهيك عن المصاريف الإضافية المكلفة من جراء تأخر عمليات انزال البضاعة من السفن، فاضطر المشرع الجزائري إلى إيجاد سبل لتحريرها ، وأوكل تسيير جزء منها إلى الخواص الطبعيين والمعنويين من ذوي الجنسية الجزائرية أو الخاضعين للقانون الوطني، وذلك من خلال إبرام عقود امتياز قائمة على شروط وإجراءات تقوم الإدارة المينائية بتحديدها مسبقا. Abstract : The commercial port activities provided to ships play an important role in increasing the volume of international trade exchanges, However, the concentration of these services in the hands of the port authorities has led to a decline in their profitability and a decrease in their quality, not to mention the costly additional expenses resulting from the delay in opperation of unloading goods from ships, The Algerian legislator was forced to finding ways to liberate it, entrusting the management of part it to natural and legal persons of Algerian nationality or subject to national law, Through concluding concession contracts based on conditions and procedures that the port administration determines in advance. .
