تأثير الظروف الاستثنائية على بناء النصوص القانونية – الصياغة الدستورية أنموذجا-

الملخص
الملخص: تعتبر الصياغة القانونية الثوب الذي يرتديه التشريع، وهي الطريقة التي يحاول بها المشرع إيصال الفكرة إلى المخاطبين بها، واستقرار القاعدة القانونية من خلال سن تشريع يتميز بالدقة والوضوح لا يتحقق إلا بالصياغة الجيدة للنص القانوني، فالأصل العام أن القاعدة القانونية تتكون من جزئين هامين، أحدهما يتعلق بالمضمون وهو الغاية من وجودها، والثاني يتعلق بالشكل الذي يعني الطريقة المعتمدة لمعرفة هذه الغاية والوصول إليها، هذا الشكل لا يمكن أن يتحقق إلا عن طريق أسلوب وصياغة قانونية متقنة، والصياغة متى كانت ملائمة ومنسجمة يمكن أن تضمن نجاح تطبيق القاعدة القانونية، ومن هذا المنطلق فإن الصياغة الدستورية التي تعتبر أحد أنواع الصياغات القانونية تعد اللسان الناطق بجوهر النص الدستوري، فإصدار هذا الأخير إلى حيز التطبيق يمكن أن يؤثر على باقي القوانين والتشريعات باعتبارها أقل منه منزلة، الأمر الذي يدفع بالصياغة الدستورية إلى أن ترتقي في أهميتها مع كل تعديل دستوري جديد لأنها سوف تلامس مبادئ ومقومات الدولة، وتأتي هذه الورقة البحثية لتعالج مسألة صياغة النص الدستوري في الظروف الاستثنائية وخلال هذه الحالات إذا لم تراعَ معايير الصياغة السليمة قد تأتي بعض نصوص الدستور مشوبة بالنقص والغموض احياناً، ومعيبة بالتعارض أحيانا أخرى. Abstract: Legal drafting is the dress worn by legislation, which is the way in which the legislator tries to deliver the idea to those addressed by it, and the stability of the legal base through the enactment of legislation characterized by accuracy and clarity can only be achieved by good drafting of the legal text, the general origin is that the legal rule consists of two important parts, one of which is related to the content and is the purpose of its existence, and the second is related to the form, which means the method adopted to know this end and reach it, this form can only be achieved through a legal style and drafting Elaborate, and the wording when it is appropriate and consistent can ensure the success of the application of the legal rule, and from this point of view, the constitutional drafting, which is one of the types of legal formulations, is the tongue that speaks the essence of the constitutional text, the issuance of the latter into practice can affect the rest of the laws and legislation as less than him, which pushes the constitutional drafting to rise in importance with each new constitutional amendment because it will touch the principles and components of the state, this research paper comes to address the issue of drafting the constitutional text in exceptional circumstances and during these cases, if the proper drafting standards are not taken into account, some of the Constitution's texts may come incomplete and ambiguous sometimes, and flawed by inconsistency other times.
