النكاح بنية الإضمار _ دراسة فقهية_

الملخص
كون الأسرة تشكّل أساس المجتمعات، فقد أولتها الشريعة الإسلامية اهتمامًا كبيرًا، يتجلى ذلك في العدد الكبير من الآيات القرآنية والأحاديث النبوية التي تنظّم شؤونها. ويأتي في مقدمة هذه الشؤون الزواج والطلاق، باعتبارهما من أهم القضايا التي تتعلق بالأسرة. ولقد استخدمت المنهج الوصفي المقارن لإنجاز هذه الورقة البحثية والتي خلصنا فيها إلى أن الشريعة الإسلامية حريصة على الأسرة ومقومتها وأن كل مايُفسد كيانها ويؤدي إلى فساد مصالح العباد فإنها تسد بابه منعا للذريعة التي تحصل من خلال مثل هذه الأنكحة . Since the family is the foundation of societies, Islamic law has given it significant attention. This is evident in the numerous Qur'anic verses and prophetic traditions that regulate its affairs. At the forefront of these matters are marriage and divorce, as they are considered among the most important issues concerning the family. I employed a comparative descriptive approach to complete this research paper, in which we concluded that Islamic law is keen on protecting the family and its integrity. It closes any door that may lead to the corruption of family interests, preventing any actions that could undermine the family structure, including such types of marriages.
