الصفقات العمومية في الجزائر على ضوء التعديل الدستوري 2020 والقانون 23-12 : التطورات والتحديات

الملخص
تهدف هذه الدراسة إلى تحليل مستجدات مجال الصفقات العمومية في الجزائر في ضوء التعديل الدستوري لسنة 2020 والقانون رقم 23-12 وتتناول الدراسة بشكل خاص التأثير القانوني لهذه الإصلاحات على تنظيم الصفقات العمومية، مع التركيز على أهم التغييرات التي طرأت على هذا المجال. أظهرت نتائج الدراسة أنّ التعديل الدستوري لسنة 2020 و القانون رقم 23-12 أحدثا ثورة في مجال الصفقات العمومية في الجزائر، حيث أصبح هذا المجال من اختصاص البرلمان و تم تفعيل رقمنة الصفقات بشكل كبير بإعتبار أن التعاقد الإلكتروني أصبح له دور كبير في الشفافية ومكافحة الفساد وكذا حماية المال العام. كما أكدت الدراسة على أهمية المجلس الوطني للصفقات العمومية في ضمان الشفافية والتحكم في إجراءات الصفقات العمومية. و أظهرت الدراسة أيضاً التزام القانون بترقية الإنتاج الوطني و حماية البيئة خلال عملية إبرام الصفقات العمومية. This study aims to analyze the latest developments in the field of public procurement in Algeria in light of the 2020 Constitutional Amendment and Law No. 23-12. The study specifically examines the legal impact of these reforms on the organization of public procurement, focusing on the key changes that have occurred in this area. The study findings revealed that the 2020 Constitutional Amendment and Law No. 23-12 have revolutionized public procurement in Algeria, making it a jurisdiction of the Parliament and significantly implementing the digitization of procurement transactions, as electronic contracting plays a significant role in enhancing transparency, combating corruption, and safeguarding public funds. The study also emphasized the importance of the National Council for Public Procurement in ensuring transparency and controlling public procurement procedures. Moreover, the study highlighted the law's commitment to promoting national production and protecting the environment during the process of public procurement.
