تقييد في مسألة تحديد الأصول والأصولي للعلامة أحمد بن مبارك السجلماسي "تقديم وتحقيق"

الملخص
تتناول هذه الدراسة تحقيق وتقديم لـ"تقييد في مسألة تحديد الأصول والأصولي" لابن مبارك السجلماسي، ومن أبرز أسباب اختياري لهذا الموضوع؛ خدمة التراث الأصولي المغربي، وتهدف هذه الدراسة إلى الاستفادة من مناهج علمائنا في الإجابة عن الإيرادات التي ترد عليهم، من قبيل لماذا جرى الخلاف في تعريف أصول الفقه؟ ومن هو الأصولي؟ وقد اتبعت فيها المنهج التاريخي في ترجمة المؤلف، والمنهج الوصفي للمخطوط، ومنهج تحقيق النص، وكل ذلك في مبحث للتعريف بالمؤلف، ومبحث في أهمية الموضوع ومنهجي في تحقيق النص، ومبحث أخير في النص المحقق. وقد خلصت في هذه الدراسة إلى نتائج أهمها: أن أصول الفقه يطلق بإزاء معان ثلاثة: القواعد، وإدراكها، وعلى الملكة، وعلى هذا جرى الخلاف في تحديده. أن مسألة تحديد أصول الفقه ينبني عليها مسألة من هو الأصولي. This study deals with the investigation and presentation of "Restriction in the issue of determining the origins and the originator" by Ibn Mubarak Al-Sijilmasi. One of the most important reasons for my choice of this topic is to serve the Moroccan originator heritage. This study aims to benefit from the methods of our scholars in answering the objections raised against them, such as why there was disagreement in defining the origins of jurisprudence? Who is the originator? I followed the historical method in translating the author, the descriptive method of the manuscript, and the method of verifying the text, all in a section to define the author, a section on the importance of the topic and my method in verifying the text, and a final section on the verified text. In this study, I reached the most important results: that the origins of jurisprudence are used in relation to three meanings: the rules, their understanding, and the ability, and this is the basis for disagreement in defining it. The issue of determining the origins of jurisprudence is based on the issue of who is the originator.
