دور القاضي في اثبات الأخطاء الطبية

الملخص
ملخص: يلعب القاضي دور إيجابي في مجال إثبات الخطأ في مجال المسؤولية الطبية، فهو لم يعد مجرد متفرج صامت حيال تبادل أطراف الخصومة مهمة الإثبات، فيقوم بالبحث عن كل سلوك من شأنه أن يوصف بالخطأ، ويقوم في سبيل تحقيق ذلك بمقارنة سلوك الطبيب محل المساءلة بسلوك طبيب عادي وسط وجد في نفس الظروف الخارجية التي وجد فيها الطبيب المسؤول حين يتعلق الأمر بالأخطاء المتعلقة بالإنسانية الطبية، أما الأخطاء المهنية أو ذات الطابع الفني فاعتبار سلوك الطبيب خطأ أم لا، يخضع للتقدير من طرف القاضي بتطبيق المعيار الموضوعي الفني، وذلك بمقارنة سلوك الطبيب المسؤول مع السلوك الفني لطبيب وسط من نفس الاختصاص محاط بنفس الظروف الخارجية التي وجد فيها الطبيب المسؤول والبحث في مدى احترام الأصول العلمية المستقرة في مهنة الطب، وفي حالة تعذر ذلك على القاضي بسبب بعض الإشكالات العلمية الخارجة عن مجال اختصاصه يقوم بإسناد المهمة إلى الخبير الطبي الذي يقوم بإعداد تقرير يعتمد علية القاضي في تقدير سلوك الطبيب الفني رغم عدم إلزاميته له. Abstract : Judge plays a positive role in the field of proof of error in the field of medical liability no longer merely a silent spectator of the parties to the adversary's exchange of evidentiary duty, He searches for every behavior that would be described as a mistake. to achieve this, it compares the doctor's behavior with that of an ordinary physician in the same external circumstances as the physician in charge when it comes to errors related to medical humanity, Professional or technical errors consider the doctor's conduct to be an error or not subject to judgement by the judge to apply the technical objective standard. by comparing the responsible physician's behavior with that of a middle physician of the same specialty surrounded by the same external circumstances in which the responsible physician found and researched the extent to which stable scientific assets in the medical profession were respected, If the judge is unable to do so because of certain scientific problems beyond his sphere of competence, he assigns the task to the medical expert who prepares a report that relies on the judge to assess the doctor's technical behavior even though he is not obliged to do so.
