دراسة نظرية سوسيولوجية لبنية الفعل الإجرامي للجماعة الإجرامية

الملخص
الملخص: تهدف الدراسة النظرية السوسيولوجية لبنية الفعل الإجرامي عند الجماعة الاجرامية لتحليل العلاقة بين البنية وهي القواعد والمصادر المسؤولة عن توجيه أشكال التنظيم الاجتماعي منها: نظام اجتماعي، نظام اقتصادي، نظام قانوني...الخ وظهور الفعل الإجرامي عند الجماعة الإجرامية، وهذا تحديدا لمعرفة الانعكاسات التي تطرأ على مختلف النظم الاجتماعية، في كيفية تشكل وبناء الفعل الإجرامي عند الجماعة الإجرامية. ومن بين أهم النتائج المتوصل إليها كالتالي: - أن للوسط الاجتماعي البيئة الاجتماعية الفقيرة والمهمشة دور في بناء الفعل الإجرامي، لأن الفرد يكتسب سلوكاته من الجماعة التي يعيش معها (التنشئة الاجتماعية). - تدهور الوضع الاقتصادي والاجتماعي والقانوني يؤدي إلى الانحراف والجريمة نتيجة فشل الإصلاحات التنموية على مستوى النظام الاقتصادي والاجتماعي والقانوني، وبالتالي تتشكل جماعة إجرامية مختصة في ارتكاب مختلف الجرائم كتنظيم الهجرة الغير شرعية عبر قوارب الموت، بيع المخدرات، جرائم السرقة... - ان بنية الفعل الإجرامي عند الجماعة الإجرامية تتشكل وفقا للنظام الاجتماعي من خلال وجود علاقة ترابطية بين البنية وهي القاعدة المسؤولة عن عملية تنظيم أشكال النظام الاجتماعي وبين الفعل الإجرامي. Abstract : The sociological theoretical study of the structure of the criminal act in the criminal group aims to analyze the relationship between the structure, which is the rules and sources responsible for guiding the forms of social organization, including: a social system, an economic system, a legal system...etc. On the various social systems, on how the criminal act is formed and built by the criminal group. Among the most important results reached are as follows: -The social milieu, the poor and marginalized social environment, has a role in building the criminal act, because the individual acquires his behavior from the group he lives with (socialization). - The deterioration of the economic, social and legal situation leads to delinquency and crime as a result of the failure of development reforms at the level of the economic, social and legal system, and thus a criminal group is formed specialized in committing various crimes such as organizing illegal immigration through death boats, selling drugs, theft crimes ... - The structure of the criminal act in the criminal group is formed according to the social system through the existence of an interdependent relationship between the structure, which is the rule responsible for the process of organizing the forms of the social system, and the criminal act.
