وسائل معالجة اللبس والغموض في لغة التشريع - الأنظمة السعودية أنموذجًا

الملخص
أهداف البحث: تِبيان صور اللبس الغموض في لغة تشريع بعض مواد الأنظمة السعودية، وتجليتهما. منهج البحث: طبّقت الدراسة المنهج الوصفي، وذلك على النحو الآتي: تحديد الألفاظ والعبارات التي قد تسبب اللبس والغموض في الأنظمة السعودية ووصفها، ثم تحليل مواد التشريع التي قد يُشكل فهمها على قارئ الأنظمة السعودية. أهم النتائج: إن اللبس والغموض في لغة مواد الأنظمة السعودية قد يكون في دلالة الألفاظ، أو في دلالة التراكيب اللغوية، أو في دلالة الأساليب. وإن مواد الأنظمة قد تكون ظاهرة الدلالة على المعنى، وقد لا تكون كذلك؛ لأن المادة قد تحتمل أوجه إن لم تكن محددة وواضحة بمفهومها ومنطوقها. وإن لغة مواد الأنظمة بحاجة ضرورية إلى وضوح أكثر من غيرها؛ لأن الأحكام الواردة فيها ترد في صورة مختصرة، وموجزة مما يؤدي في أحيانٍ كثيرة إلى صعوبة فهم مراد المشرِّع. أهم التوصيات: الاهتمام بلغة القانون عامةً؛ نظرًا لضرورة وضوح لغته التي تؤثّر في صحة تطبيق ما ورد فيه من أحكام فضلًا عن أنه علم بيني يجمع بين قطبي اللغة والقانون. This study investigated means of dealing with ambiguity and mystery in the language of legislation in some articles of Saudi regulations. The subject of the research: means of dealing with ambiguity and mystery in the language of legislation Saudi Articles as a model. research objectives: Identifying the forms of ambiguity in the language of legislation in some articles of Saudi regulations, and showing them. Research Methodology: the study used the descriptive method, as follows: Identifying and describing the words and phrases that may cause the ambiguity and mystery in Saudi regulations, then analyzing the legislative articles that might be difficult to be understood by the reader of Saudi regulations. The most important results: The ambiguity and mystery in the language of the articles of the Saudi regulations may be in the meaning of the words, the meaning of the linguistic structures, or the meaning of the styles. The articles of regulations may identify the meaning clearly or not. Because the article may have several aspects if it is not specific and clear in its concept and pronunciation. The language of the articles of regulations must be clearer than other articles, because of the rules contained therein are presented in a brief form, which often leads to difficulty in understanding the intent of the legislator. The most important recommendations: Paying attention to the language of law; due to the necessity of clarifying its language, which affects the correctness of its application, ease of understanding, and due to its being an intermediate science that combines both of language and law.
