الملخص
يتمحور موضوع دراستنا حول التحول الديمقراطي كآلية ومعيار لترسيخ وبناء مفهوم الدستور الديمقراطي، المبني على الأسس والمعايير الديمقراطية يكفل الحقوق والحريات العامة، ويؤسس للعلاقة بين الدولة والمجتمع المدني، فإن حقيقة الدستور في جوهره هو عبارة عن توافق مجتمعي، وعليه فالعلاقة بين هذه الأخيرة هي علاقة ترابطية، ضامنة لأركان الحياة الديمقراطية من الحقوق والحريات الأساسية وضمانات للدستور في حد ذاته، يراعي الواقع ويأخذ في الاعتبار ضروريات التوافق السياسي. The subject of our study revolves around democratic transformation as a mechanism and standard for consolidating and building the concept of a democratic constitution, which is built on democratic foundations and standards, guarantees public rights and freedoms, and establishes the relationship between the state and civil society. The reality of the constitution, in its essence, is a societal consensus, and therefore the relationship between the latter is an interconnected relationship, guaranteeing the pillars of democratic life of basic rights and freedoms and guarantees for the constitution itself, taking into account reality and taking into account the necessities of political consensus.
