Administrative Settlement Of Disputes Related To The Privileges Granted To The Investor Under Law 22-13 Related To Investment

Abstract

The Algerian legislator attached great importance to the issue of investment because of its effective and prominent role in changing economic relations and achieving comprehensive development, and that is through his attempt in every amendment to it to provide a suitable and attractive investment climate, and as a result of the special nature that distinguishes investments and that results Regarding the privacy and subjectivity of investment contracts and the multiplicity of their parties, it is conceivable that disputes will arise between their parties regarding the application and interpretation of their provisions, which necessitated the legislator to provide effective means to settle these disputes, as it opened the way for resolving disputes related to the privileges granted to the investor under Law 22-13 for judicial settlement. And amicable, the latter of which allows the dispute to be settled through simplified administrative procedures through which he can regain his right to benefit from the benefits away from the intervention of the judiciary أولى المشرع الجزائري أهمية كبيرة لموضوع الاستثمار لما له من دور فعال و بارز في تغيير العلاقات الاقتصادية و تحقيق التنمية الشاملة ، و ذلك من خلال محاولته في كل تعديل له أن يوفر مناخ استثماري ملائم و جذاب ، و نتيجة للطبيعة الخاصة التي تميز الاستثمارات و التي تنجم عن خصوصية و ذاتية عقود الاستثمار و تعدد أطرافها ، فإنه من المتصور نشوء منازعات بين أطرافها حول تطبيق و تفسير بنودها ، مما استوجب على المشرع توفير وسائل فعالة لتسوية تلك المنازعات ، حيث فسح المجال لحل النزاعات المتعلقة بالامتيازات الممنوحة للمستثمر بموجب القانون 22-13 للتسوية القضائية و الودية ، هذه الاخيرة التي تسمح بتسوية المنازعة عن طريق اجراءات ادارية مبسطة يمكنه من خلالها استرجاع حقه في الاستفادة من المزايا بعيدا عن تدخل القضاء .
