Abstract
In view of the importance of commercial companies in stimulating any economy, it was necessary to search for the measures stipulated in the Algerian commercial law to protect the debtor company from financial difficulties, and help it to carry out its economic and social roles. A look based on a good study and real diagnosis of the debtor company and its ability to regain its position in the market. نظرا لأهمية الشركات التجارية في تحفيز أي اقتصاد، اقتضى الأمر البحث في التدابير المنصوص عليها في القانون التجاري الجزائري لحماية الشركة المدينة من الصعوبات المالية التي قد تعترضها، ومساعدتها للقيام بأدوارها الاقتصادية والاجتماعية، وتوصلنا بالنتيجة لوجود خلل وتناقض يتطلب الانتقال من جمود وعجز النص التشريعي في هذا الشأن إلى نظرة تعتمد الدراسة الجيدة والتشخيص الحقيقي للشركة المدينة ولقدرتها على استرجاع مكانتها في السوق.
