الدولة الحامية كآلية لتطبيق أحكام القانون الدولي الإنساني

الملخص
تعد آلية الدولة الحامية آلية أساسية وذات أهمية بالنسبة لتنفيذ القانون الدولي الإنساني خلال النزاعات المسلحة الدولية، إذ تعتمد هذه الآلية على أساس قانوني نابع من اتفاقيات جنيف الأربع لعام 1949 والبروتوكول الإضافي الأول لعام 1977. ومن خلال هذه الآلية تقوم دولة محايدة تختارها الدولة المحتلة أراضيها لتتولى حماية مصالحها والإشراف على تطبيق أحكام الاتفاقيات الدولية. ومن اجل هذا سوف نقسم الدراسة إلى مبحثين أساسيين، يتناول الأول مفهوم الدولة الحامية، ونقسمه إلى ثلاثة مطالب: الأول إلى تعريف آلية الدولة الحامية وأهميتها، أما المطلب الثاني نتطرق لنشأة هذه الآلية وتطورها، ثم نعرج على المطلب الثالث الذي نتطرق فيه إلى الأساس القانوني لآلية الدولة الحامية. أما المبحث الثاني فسوف نبحث في تطبيق آلية الدولة الحامية، والذي نقسمه إلى مطلبين: الأول نستعرض فيه طريقة تعيين الدولة الحامية، ثم المطلب الثاني وظائف الدولة الحامية. ونختتم البحث بعرض أهم النتائج والاقتراحات التي خلصنا إليها. Abstract: The mechanism of the protective state is considered a fundamental and important mechanism for the implementation of international humanitarian law during international armed conflicts, as this mechanism is based on a legal basis from the four Geneva Conventions of 1949 and the First Additional Protocol of 1977. Through this mechanism, a neutral state is chosen by the country occupying its lands to protect its interests and supervise the implementation of the provisions of international agreements. For this reason, the study will be on two main sections, the first is about the concept of the protective state mechanism and it is divided into three requirements: The first requirement is the definition of the protective state mechanism and its importance, the second requirement is the study of the emergence and development of the protective state mechanism, while the third requirement is the study which of the legal base of the protective state mechanism. While the second section, is about we will examine the application of the mechanism of the protective state, which we will divide into two requirements: the first in which we will review the method of designating the mechanism of the protective state, and then the second requirement: the functions of the protective state. Finally I concluded the research by presenting the most important results and suggestions which have reached.
