المشروعية في أعمال السلطة بين عدالتي القانون والسياسة

الملخص
ملخص : تحمل المشروعية دور الحامي للأعمال التي تُمارسها السلطة، فلما كان الحديث عن خضوع الحاكم والمحكومين لسمو القانون بمعناه الواسع يبني لعلاقة تحكمها سيادة الدستور والقانون، فإن المشروعية جعلت من تلكم العلاقة محور جدل بين المبتغى القانوني والمسعى السياسي،فمتى التزمت الدولة بالمشروعية في مجالها العادي المحدد لها في مظاهر احترام التدرج الهرمي للقوانين، والفصل الموضوعي بين السلطات اعتبرت محققة للمشروعية في مجالها القانوني، أما متى خضعت نشاطاتها لنوع من الخصوصية في الأوضاع غير العادية للمشروعية وهي الحالات الاستثنائية، والسلطة التقديرية، وحتى أعمال السيادة اعتبرت المشروعية ذات بعد سياسي، ليتضح على هذا النحو حقيقة أن المشروعية لها معنى نسبي ومرن لا يؤدي إلى غيابها بقدر ما يؤكد لحقيقة أنها محور بناء الدولة مع ضمان الحفاظ على المشروعية في حالتيها من تأمين للنشاط الحزبي الحر والمجتمع المدني الفاعل. The legitimacy has a role in protecting the activities of the authority, So When talking about the submission of the ruler and the convicts to the supremacy of the law in its broadest sense, it is establishes a relationship. It is governed by the rule of the constitution and the law. then the legitimacy made that relationship a pole of controversy between the legal goal and the political goal. Therefore the state"s commitment to legitimacy in its ordinary sphere, which appears in respect for the sequence of laws and the substantive separation of powers only at this time will the state considered to have achieved legitimacy in its wide scope, but when is its activities characterized by a kind of privacy in unusual cases of legality such as exceptional cases and discretionary power and even acts of sovereignty here is considered to have political dimensions, So in this way the fact that legitimacy has a flexible meaning that does not lead to its absence becomes clear but confirms. that it is the pivot of state building with preserving the legitimacy in both cases of securing free partisan activity and an active civil society.
