الملخص
تنصّب هذه الورقة العلميّة حول القانون رقم 24-01 المتضمّن تدابير خاصّة للحصول على النّفقة، كأنموذج بارز، له وزن كبير في حماية الحقوق الماديّة لشريحة الأطفال وأمّهاتهم المطلّقات، ويعكس سعي المشرّع الجزائري وجهوده لترقيّة حقوق الطّفل والمرأة. إشكاليّة الدّراسة ما هو الإطار القانوني للقانون المتضمّن تدابير خاصّة للحصول على النّفقة؟، وما مدى نجاعة آلياته في حماية حقوق الطّفل والمرأة؟. الإجابة عن الإشكاليّة تكون ضمن خطّة ثنائيّة، تتركّز حول القراءة التحليليّة لبنود القانون المتضمّن تدابير خاصّة للحصول على النّفقة، مدعّمة بقراءة نقديّة موضوعيّة، تبيّن إيجابياته ومثالبه النّظريّة والتطبيقيّة. Legal mechanisms for protecting women and children’s rights (Law No. 24-01 containing special measures for obtaining alimony as a model) This scientific paper revolves around the Law No. 24-01, which includes special measures for obtaining alimony, as a prominent model, that significantly protects the financial rights of children and their divorced mothers. It reflects the Algerian legislator’s efforts to enhance the rights of children and women. Research problem: What is the legal framework of the law that includes special measures for obtaining alimony? and how effective are its mechanisms in protecting both children and women rights?. The answer is approached through a bilateral plan focusing on the analytical interpretation of the clauses of the law, which includes determining special measures to obtain alimony; supported by an objective critical analysis that illustrates its theoretical and practical advantages and shortcomings.
