نحو التزامات جديدة في العلاقة العقدية تحقيقا للتوازن العقدي

الملخص
إن التطورات الكبيرة في العلاقات الاقتصادية والاجتماعية وتعمق مظاهر اختلال التوازن في التزامات المتعاقدين نتج عنه الدخول في علاقات تعاقدية غير متكافئة ، كل ذلك أدى إلى التأثير على نظام العقد وجعله أكثر تكيفا مع مقتضيات التطور، من خلال استحداث التزامات عقدية جديدة ،أما عن الوسائل المستعملة لتحقيق الهدف فترتكز على تقنیة حسن النية ومبدأ التوازن العقدي والعمل على الاستمراریة العقدیة، وخاصة على التدخل المتزاید للقاضي في العقد ضمانا لتحقيق العقد لوظيفته الاقتصادية. Summary : Significant advancements in economic and social relations, coupled with deepening imbalances in the obligations of contracting parties, have resulted in the emergence of unequal contractual relationships. These changes have affected the contractual system, prompting it to adapt more effectively to developmental needs by incorporating new contractual obligations. The methods employed to achieve this aim center on the principles of good faith and contractual balance, as well as the promotion of contractual continuity. This is particularly evident in the increasing role of judicial intervention, which ensures that contracts fulfill their intended economic functions Les développements majeurs dans les relations économiques et sociales et l’approfondissement des manifestations de déséquilibre dans les obligations des parties contractantes ont abouti à la conclusion de relations contractuelles inégales. Tout cela a conduit à influencer le système contractuel et à le rendre plus adaptable aux exigences du développement, par la création de nouvelles obligations contractuelles. Quant aux moyens utilisés pour atteindre l’objectif, ils reposent sur la technique de la bonne foi et le principe d’équilibre contractuel et travaillent sur la continuité contractuelle, notamment sur l’intervention croissante du juge dans le contrat pour s’assurer que le contrat réalise sa fonction économique. .
