A guarantee is recognized as a designated contractual arrangement, defined by standard legal stipulations in civil law, which legislators have integrated into the domain of public procurement as a safeguard to preserve public assets against mismanagement. This obligation is legally imposed on contractors to ensure the proper execution of public projects. This study delves into the legal framework governing such guarantees, scrutinizing their efficacy in securing public procurement through an analysis of the guarantee's legal definition, its prerequisites, and its implementation in public procurement settings.
