رقمنة القضاء المدني في التشريع الجزائري Digitization Of The Civil Judiciary In Algerian Legislation

الملخص
تهدف دراسة هذا الموضوع إلى تحديد الآليات التي إستند إليها المشرع الجزائري في تطبيق الرقمنة أمام القضاء المدني و ذلك في مختلف الإجراءات التي تتخذ في إطاره، و كذا دراسة مدى امتداد الرقمنة إلى وسائل الاثبات التي يستند إليها الخصوم في إثبات إداعاءاتهم. لقد باشر المشرع الجزائري رقمنة إجراءات القضاء المدني عن طريق تمكين الخصوم من إرسال الوثائق و المستندات بطريق إلكتروني، و هو ما يجسد وجود الدعوى المدنية الإلكترونية، أما عن رقمنة الإثبات فكانت أول إشارة لها سنة 2005 عن طريق إعتماد الكتابة الإلكترونية، لتظهر بعدها وسائل أخرى ساهمت في تكريس الإثبات الإلكتروني أمام القضاء المدني الجزائري. The study of this topic aims to determine the mechanisms which the Algerian legislator relied in applying digitization before the civil judiciary in the various procedures taken within it, as well as studying extent which digitization extends to the means of evidence that opponents rely on to prove their claims. the Algerian legislator has begun to digitize civil judicial procedures by enabling opponents to send papers and documents electronically, which reflects the existence of electronic civil litigation as for the digitization of evidence, its first indication was in 2005 through the adoption of electronic writing, after which other means appeared that contributed to in establishing electronic evidence before the Algerian civil judiciary.
