مبدأ المساواة في التوظيف كتدبير وقائي لمكافحة الفساد الاداري في التشريع الجزائري

الملخص
نظم المشرع الجزائري مبدأ المساواة في التوظيف ضمن عدة قوانين ، حيث كرسه كمبدأ أساسي للديمقراطــــــــــــية والشفافية في الدساتير الوطنية وهو ما تضمنه أخر تعديل دستوري لسنة 2020، بما في ذلك القانون رقم 06-01 للوقاية من الفساد ومكافحته الذي بدوره جسده من خلال عدة مظاهر ، إضافة إلى الأمــــــــــــــــــر رقم 06-03 المتـــــــــــعلق بالقانون الأساسي العام للوظيفة ، وهو كذلك بــــــــــدوره تضمن مبدأ المساواة كمبدأ أساسي ضمانا لتكافئ الفرص لتقلد الوظائف العامة، إضافة إلى المبادئ الأخرى كمبدأ الشفافيــــــــــــــــة والجدارة والنزاهة المجسدة لمبدأ المساواة في التوظيف. وبهذا يمكن القول أن المشرع الجزائري وفر حماية أكثر للتوظيف ، نظرا لأهمية الالتزام بهذا المبدأ في الالتحاق بالوظائف العامة كتدبير وقائي من أجل التصدي لكل أنواع وأشكال الفساد الإداري . The Algerian legislator has regulated the principle of equality in employment within several laws dedicating it as a fundamental principle for democracy and transparency in national constitutions, as ensured by the latest constitutional amendment of 2020. This includes Law No06-01 for the prevention and combating of corruption, which embodies it through various aspects, in addition to Law No. 06-03 concerning the general basic law of public employment which also guarantees it as a fundamental principle to ensure equal opportunities for public office. Other principles such as transparency, competence, and integrity are also embodied in the principle of equality in employment. Thus, it can be said that the Algerian legislator has provided greater protection in employment, given the importance of adhering to this principle in .joining public offices as a preventive measure to combat all forms of administrative corruption
