فعالية آليات الملكية العقارية في تفعيل الاستثمار الفلاحي في الجزائر

الملخص
تسعى الجزائر بجد إلى تطوير القطاع الفلاحي، من خلال إعتماد اصلاحات بارزة ضمن القطاع الفلاحي، تبعا لظهور مواضيع مستجدة مرتبطة بالقطاع الفلاحي حيث يتمثل أهمها من خلال تعزيز الأمن الغذائي وتقليص الواردات الفلاحية، بالإضافة إلى المساهمة في نمو وتنويع الاقتصاد الوطني وخلق فرص اقتصادية ومناصب عمل جديدة لسكان الأرياف، مما يساعد على تقليل الهجرة الريفية وتحسين مستوى معيشتهم. يشغل القطاع الفلاحي مكانة هامة في التنمية الاقتصادية والاجتماعية للوطن، ذلك أن البعد الاقتصادي للعقار الفلاحي أصبح أكثر وضوحا في كون الأراضي الفلاحية أصبحت مصدرا للثروة الغذائية والسبيل لتحقيق الأمن الغذائي والمحرك الأساسي للاقتصاد الوطني. ومن أجل الوصول إلى هذه الغاية، بات من الضروري جدا الاهتمام بالملكية العقارية الفلاحية وتنظيمها تنظيما يكفل الغاية المرجوة منها، لذا اعتمد المشرع الجزائري على آليات لتطهير الملكية الفلاحية من أجل دعمها في الاستثمار الفلاحي، سواء في القانون رقم 90/25 المتعلق بالتوجيه العقاري، أو القانون رقم 08/16 المتعلق بالتوجيه الفلاحي. Algeria is diligently striving to develop the agricultural sector by implementing significant reforms within this field, in response to emerging issues related to agriculture. The most important of these issues includes enhancing food security and reducing agricultural imports, in addition to contributing to the growth and diversification of the national economy and creating economic opportunities and new jobs for rural residents, which helps to reduce rural migration and improve their standard of living. The abstract The agricultural sector occupies an important place in the economic and social development of the country, as the economic dimension of agricultural real estate has become more evident in the fact that agricultural lands have become a source of food wealth, a way to achieve food security and the main engine of the national economy. In order to reach this goal, it has become necessary to pay attention to agricultural real estate and organize it in a way that ensures the desired purpose, so the Algerian legislator has adopted mechanisms to purify agricultural property in order to support agricultural investment, whether in Law No. 90/25 on Real Estate Orientation or Law No. 08/16 on Agricultural Orientation.
