جريمة التحريض على التنمر عبر وسائط التواصل الاجتماعي- دراسة مقارنة

الملخص
تعتبر جريمة التحريض على التنمر أحد الجرائم التي ألقت بظلالها وآثارها الوخيمة على جل المجتمعات بما فيها المجتمع الجزائري، خاصة في الآونة الأخيرة في ظل انتشار تكنولوجيا الاتصال والأنترنت، حيث ظهر ما يعرف بالتنمر الإلكتروني (السيبراني) والتحريض عليه من خلال وسائط الأنترنت، التي عملت على تنامي هذه الجريمة بشكل خطير ومتسارع، فمن خلال هذه الورقة البحثية حاولنا استعراض التحريض على التنمر عبر الوسائط الاجتماعية من خلال بيان الإطار المفاهيمي والنموذج القانوني لها، وكذا المواجهة الجنائية الموضوعية المرصودة لمكافحتها والتصدي لهذا السلوك المشين الذي من شأنه تهديد أمن المجتمعات وزعزعة استقرارها، والمساس بحقوق وحريات الأفراد وكرامتهم وما تحمله في طياتها من آثار سلبية كبيرة تعود على نفسية الضحايا من خلال التعريج على موقف بعض النظم المقارنة إزاءها كالمشرع المصري مثلا. Abstract: The crime of incitement to bullying is one of the crimes that have cast a shadow and its dire effects on most societies, including Algerian society, especially recently in light of the spread of communication technology and the Internet, where what is known as cyberbullying and incitement to it appeared through the Internet, which worked on the growth of this crime dangerously and rapidly, through this research paper we tried to review incitement to bullying through social media by explaining the conceptual framework and legal model for it, As well as the objective criminal confrontation designed to combat it in order to deter anyone who begged himself to commit this disgraceful behaviors that would threaten the security of societies and destabilize them and prejudice the rights and freedoms of individuals and their dignity and what it bears it has great negative effects on the psyche of the victims by looking at the position of some comparative legislation on this crime, as an example of the Egyptian legislator.
