Abstract: The issue of brain drain is one of the biggest challenges hindering the development process in developing countries, and it is constantly increasing in recent times with the magnitude of the losses resulting from it, especially in the issue of benefiting from the discoveries and inventions of this group, which the receiving developed countries acquire and monopolise their use and transfer to developing countries, and this monopoly is manifested in the enactment of laws related to the protection of intellectual property in these countries. The role of developing countries in protecting intellectual property rights remains fragile, which requires reconsideration in order to search for mechanisms capable of encouraging the research and development process, thus preserving competencies and countering the phenomenon of migration while working to create the necessary conditions to attract and retrieve migrant brains.
